These Terms of Service (“Terms”) are an agreement between you and Black Eye Media (“we,” “us,” or “our”) for use of The Lost mobile application and related API (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
The Lost provides AI-assisted conversational recreations based on information you supply, including chat exports, memories, and optional voice samples. Personas and synthesized voices are digital recreations. They are not the real people they resemble, and they are not a substitute for that person, for professional care, or for human companionship.
Features may include text chat, voice notes, playback of cloned speech, persona profiles, and paid subscriptions that unlock additional usage. We may change, suspend, or discontinue features where reasonably necessary to operate the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
You are responsible for the accuracy of your account information and for keeping login credentials confidential. You must notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms, that present a security or legal risk, or that remain inactive for an extended period.
You retain rights in the materials you upload (for example chat exports, photos, and voice samples). You grant us a limited license to host, process, transmit, and display that material solely to provide the Service to you, including sending it to processors described in the Privacy Policy (such as LLM and voice providers).
You represent that you have the necessary rights or permissions to upload this data, including any rights relating to a person’s image, voice, and personal data after death, where such rights exist in your jurisdiction. Do not upload another living person’s private communications or voice without a lawful basis to do so.
The Lost is intended for personal reflection, memory-keeping, and connection with the memory of someone you have lost. You may not use personas, voice cloning, or generated content to:
We may suspend or terminate accounts that violate this section. We are not responsible for losses arising from a user’s violation of this section.
The Service may include a limited free trial (for example a cap on chat interactions). Paid plans are billed through Paddle, which acts as merchant of record. Fees, plan limits, renewals, and cancellation are described in the app and at checkout. Taxes may apply.
Unless required by law or by the app store through which you paid, fees are generally non-refundable once a billing period has started. See our Refund Policy for details. You can manage or cancel a subscription via the in-app customer portal. Cancellation takes effect at the end of the current paid period unless otherwise stated at checkout.
Where Apple or Google require platform billing for digital subscriptions, those stores’ payment terms also apply. Native in-app purchases may be added later; until then, subscriptions in the current app are processed by Paddle.
The Lost is not medical, therapeutic, counseling, or crisis care. It does not diagnose or treat any condition. If you are in crisis or thinking about harming yourself or others, contact local emergency services or resources such as 988 (US, call or text) or findahelpline.com.
The Lost name, branding, app, and software are owned by Black Eye Media or its licensors. Except for the limited license in section 4, these Terms do not grant you any right to copy, reverse engineer, or resell the Service.
We aim for reasonable availability but do not guarantee uninterrupted Service. Voice cloning, speech synthesis, and AI replies depend on third-party providers and usage caps; quality and latency will vary. We may update these Terms; the “Last updated” date will change, and continued use after notice of material changes constitutes acceptance.
To the fullest extent permitted by law, Black Eye Media is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service or from generated content, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the three months before the claim or (b) fifty US dollars (US$50).
Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the maximum extent permitted by law.
